1 OFFER

1.1 The sale of the products offered on the website www.sciasciacollection.com (hereinafter referred to as the "Site") is governed by the following General Terms and Conditions (hereinafter referred to as the "General Terms").

1.2 SciàScià® is a trademark of Rigato Susanna, registered in the Venice Company Register and VAT no. 0456906272, REA Venice registration no. 428487, with registered office in Corso Silvio Trentin 94 - 30027 SAN DONA' DI PIAVE (VE) 

1.3 The products offered on the www.sciasciacollection.com website are produced and marketed by Rigato Susanna (hereinafter referred to as Seller). For any request for information and/or communications and/or complaints regarding sales, products, payments, shipments, you can contact Customer Service at the following email: info@sciasciacollection.com

1.4 The purchase contract and the related procedures are available in Italian.

 

2 BASIC INFORMATION

2.1 The products on the Site are offered for sale exclusively to natural persons residing in the European territory who purchase the products for personal purposes unrelated to their commercial or professional activity and have reached the age of majority, with destination of the goods within the European territory.

2.2 The resale, rental or transfer of products purchased from the Site for any commercial or professional purpose is expressly prohibited. Therefore, the purchase contracts made by resellers or wholesalers or by subjects who will purchase the products for subsequent resale can be canceled pursuant to art. 1427 of the Civil Code and in any case the Seller reserves the right to terminate the contract at any time, where it ascertains or has reasonable grounds to believe, also taking into account the quantity and type of goods purchased, that the buyer does not meet the requirements to art. 2.1.

2.3 The Seller reserves the right to make changes or additions to these General Conditions at any time, by means of publication on the website www.sciasciacollection.com. In any case, the customer will be bound exclusively to the General Conditions in the text in force on the date on which the purchase order is placed.

2.4 By sending the purchase order, the customer acknowledges having carefully examined and fully accepted these  General Conditions. In this regard, the Seller recommends the customer to download, save or print the General Conditions in force at the time the purchase order is sent.

2.5 To place the purchase order it is not necessary to register on the Site, while it will be necessary to accept the General Conditions of Sale by selecting the appropriate box. Failure to accept the Conditions themselves will make it impossible to proceed with the purchase of the Products. The customer guarantees that the personal information provided during the purchase procedure is true.

 

3 PURCHASE PROCEDURE

3.1 Each product selected by the user of the Site can be viewed on a special web page which contains the description, photographic images and highlights the unit price (including VAT)  the colors and the different sizes or sizes available.

3.2 Each sale made by the Seller through the Site may concern one or more products.

3.3 The customer, by choosing the articles of his interest, will include these products in his own Shopping Cart. In the same Cart, a brief summary description of the selected products will be displayed, including the measurements or sizes, together with one or more photographic images in digital format that allow an adequate representation of the products. It is understood that in case of discrepancy between the photographic images and the summary description, the latter will prevail and will be considered indicative of the product purchased.

3.4 The customer is required to verify the accuracy of the contents of the Shopping Cart before confirming the order, completing the online purchase order form according to the instructions for the purchase procedure provided on the appropriate page of the Site and confirming that I have read and accepted these General Conditions. Once the correctness of the data relating to the selected Product/s has been verified, the Customer must choose the payment method pursuant to art. 5.

3.5 The purchase procedure is completed when the customer selects the "Confirm Purchase"  option on the order summary page displayed upon completion of the relative procedure. At this time, the order is sent directly to the Seller to be processed and cannot be further modified or cancelled.

3.6 By sending the order, the customer confirms acceptance of the provisions of these General Conditions.

3.7 The purchase order will be archived at the Seller's data centre.

3.8 The customer will also receive an order confirmation e-mail, to the address provided in the online purchase order form, containing a summary of the main contractual conditions. 

3.9 Although the Seller constantly adopts measures aimed at ensuring that the photographs shown on the Site represent the most faithful possible reproduction of the real products, it is always possible for some differences to occur due to the technical characteristics and the quality of color resolution with which it is equipped the terminal or screen used by the customer. As a result of the aforementioned technical reasons, the Seller assumes no guarantee and liability for the absolute accuracy of the graphic representations of the products shown on the Site.

3.10 The Seller reserves the right to refuse purchase orders from a customer it deems unsuitable to fulfill its obligations, as in the case, for example, of a previous violation of the contractual provisions for online purchases through the Site In any case, it is understood that all the purchase orders sent constitute contractual offers and that the conclusion of the contract is left to the discretion of the Seller, who is free to accept or refuse the orders.

 

4 AVAILABILITY

4.1 The customer acknowledges the fact that the stocks of the products offered by the Seller through the Site are limited. The products considered available for purchase by customers can be viewed on the Site. Inconveniences may occasionally occur relating to the availability of certain products without this implying any liability of the Seller towards the Customers. In such circumstances, the customer will be informed of this fact as soon as possible (and in any case within the delivery terms specified below) by e-mail or by telephone; consequently the incomplete order will be canceled and the customer will be offered the possibility of placing a new order by telephone or directly with new access to the Site. The cancellation of the entire order will not involve any charge to be paid by the customer.

4.2 The Seller reserves the right to change or update the products offered on the Site at any time, without notice.

 

5 PRICE AND METHOD OF PAYMENT

5.1 The prices of all the products offered for sale on the Site are expressed in Euros (€) and are inclusive of VAT at the rate in force in Italy (currently equal to 22%) if the Products are shipped by the Seller and delivered within of European Union

5.2 The price does not include shipping costs.   The Seller reserves the right to ask Customers for a contribution towards shipping costs which may vary depending on the type of delivery, the quantity of products to be delivered , their weight and their destination.

5.3 The contribution requested by the Seller  for shipping costs is indicated, separately from the Price, before the order is sent by the Customers and will be paid by the Customer together with the payment of the price.

5.4 The total amount, together with the shipping costs charged to the customer, if foreseen, as specified below, will be highlighted in the Shopping Cart and in the order summary page displayed upon completion of the relative procedure.

5.5 The Seller reserves the right to change the prices of the products offered for sale on the Site at any time and without notice. The prices published on the Site at the time the order is sent by the customer will be charged to the customer, without prejudice to the provisions of art. 4.1 in case of unavailability of the products.

5.6 The Seller only accepts payments made by credit card, PayPal or bank transfer. The Seller accepts the credit cards indicated on the relevant page of the Site.

5.7 In case of payment by bank transfer, Customers must make the transfer to the bank details indicated on the Site, specifying in the reason for payment the order number indicated by the Seller when sending the Order Confirmation.

5.8 The shipment of the products takes place exclusively following the verification of the customer's credit card details. The charge on the customer's credit card will be made exclusively following the execution of the relative order. The credit card data sent during the execution of the Orders are protected and are sent directly to the banking company that manages the payments which take place directly on a secure server in order to guarantee the absolute security of the transaction.

5.9 In case of payment via PayPal, when the customers send the orders, the web session will be transferred to the PayPal website. On this website, customers can complete the payment of the Price and any contribution for shipping costs using their PayPal account and according to the conditions of use of the PayPal service. The debit of the price and the shipping cost on the PayPal account takes place together with the sending of the order confirmation by the Seller.

5.10 The tax receipt will be sent together with the goods present in the package/s. To request it again it will be necessary to send a request via e-mail to info@sciasciacollection.com.

5.11 In the event that one or more products are not available, the customer will be contacted by telephone  according to the provisions of art. 4.1.

 

6 PRODUCT DELIVERY LIMITATIONS

6.1 Deliveries are made in all member countries of the European Union. The products will be shipped to the postal delivery address indicated by the customer in the online purchase order form.

6.2 The Seller will not ship any order addressed to a post office box or accept any order in which it is not possible to identify the person who placed the order, the recipient of the products ordered or the delivery address.

 

7 METHODS OF DELIVERY

7.1 The Seller makes use of Express Courier for shipments of orders. The Products that are available in the warehouse will normally be delivered in the shortest possible time and in any case, indicatively:

• in Italy, within 3-5 working days from receipt of payment.

• in EU countries other than Italy within 5-7 working days of receiving the payment.

7.2 The shipping costs can be viewed by the customer, together with the total price for the purchase of the products, before confirming the order, in the Shopping Cart and on the summary page of the purchase order.

7.3 The Seller undertakes to do everything in its power in order to respect the delivery times indicated on the Site and, in any case, to carry out the delivery within a maximum time of 30 (thirty) days starting from the day following that of sending the order by the Customer. If the customer has chosen the bank transfer as payment method, the delivery term will start from the receipt of the payment by the Seller.

7.4 Upon shipment of the package with the items ordered, the Express Courier will send the customer an e-mail to the address indicated in the online purchase order form which will contain a tracking code and a link that will allow delivery to be monitored.

7.5 In the event of problems or delays in delivery exceeding 10 (ten) working days following the date indicated in the order confirmation e-mail pursuant to art. 3.8, customers are required to report the fact to the email info@sciasciacollection.com using the Contact section on the Site.

7.6 The customer undertakes to check as soon as possible that the delivery includes all and only the products purchased and to promptly inform the Seller of any defect in the products received or their discrepancies with respect to the order placed according to the procedure referred to in point 9 below; otherwise the products will be considered accepted. If the packaging of the products reaches its destination clearly damaged, the Customer is invited to refuse delivery by the shipper or to accept delivery "with reserve".

 

8 WITHDRAWAL AND RETURN

8.1 The customer has the right, pursuant to and by effect of Article 64 of Legislative Decree no. 206/2005, to withdraw from the sales contract, specifying the  reasons, within 14 (fourteen) days from the date of delivery of the products, without any penalty.

8.2 In addition, the customer is guaranteed a right to return the products, which can be exercised within the same term as for the right of withdrawal for one of the reasons listed on the Site in the "Withdrawal/Return Policy" section.

8.3 To make use of the rights provided for in articles 8.1 and 8.2, the customer must follow the "Instructions" contained in the "Withdrawal/Return Policy" section of the Website.

8.4 In case of exercise by customers of the withdrawal/return rights referred to in this article: 

(i) customers undertake in any case to return the products within 10 days from the date of exercising the right of withdrawal/return; 

(ii) the shipping costs associated with returning the products are   to be paid by the customer. The customer will undertake to ship the item at his own expense, subsequently communicating to the email address  info@sciasciacollection.com the name of the shipper and the tracking number to monitor the shipment;_cc781905-5cde-3194- bb3b-136bad5cf58d_

(iii) The Seller undertakes to refund the price as soon as possible, and in any case within 30 days from the date of receipt of the returned products, provided that the same have been returned in their original, intact and unused conditions, together with the packaging / original packaging and any accessories, quality labels, and a copy of the sales documentation.

8.5 All refunds processed by the Seller will be made by the same payment method used to place the order or by bank transfer.

8.6 The Seller will not give rise to any refund of the price if the customer exercises the right of withdrawal/return in a manner that does not comply with the methods and terms set out in the Withdrawal/Return Policy and in this article.

8.7 The Seller will check whether the returned products are actually in their original conditions; if the products returned by the customer are damaged, incomplete, deteriorated and/or dirty, they will not be refunded. The right of the same to request compensation for any damage or non-correspondence with the products delivered to the customer remains unaffected. In case of withdrawal or return, the Seller will not be responsible for the loss of products, shipments to incorrect addresses or delays in the delivery of products, it being understood that the customer assumes all risk of such shipment.

8.9 In the event of a return request, the Seller reserves the right to offer the customer products to replace those returned for the same amount.

 

9 LACK OF CONFORMITY

9.1 Upon delivery, the customer must check the products to ensure that they correspond to the items ordered. Any anomaly found upon delivery (for example, tampering or damage to the packaging, damaged products, missing items, etc.) must be indicated on the delivery document in the form of an express reserve signed by the customer.

9.2 If the products do not correspond to those ordered, the customer is required to promptly inform the Seller at the email addressinfo@sciasciacollection.comand has the right to demand execution of the order, upon return of what has been received, or, in the event of unavailability of the products ordered, to order different items of the same nature or, alternatively, to be reimbursed for any price difference or to cancel the entire order, as indicated in art. 4.1.

9.3 The Seller is also liable in the event of a lack of conformity of the products, provided that the customer presents the complaint within a maximum period of 7 (seven) days from the date  of delivery.

9.4 In the event of non-conformity of the products, the customer will have the right to obtain their restoration free of charge, by means of repair or replacement.

9.5 The costs incurred by the customer for the return of the products found to be defective or non-compliant will be borne by the Seller

 

10 LIMITATION OF LIABILITY

10.1 The Seller will not be liable in any way towards the customer as a result of:

(i) damage or loss caused by the products or their use by the customer (subject in any case to the application of the mandatory rules on manufacturer's liability); 

(ii) damages that are not caused by default by the Seller; 

(iii) loss of business or trading opportunity.

 

11 INTELLECTUAL PROPERTY RIGHTS

11.1 The SciaScia® trademark, as well as the set of figurative and non-figurative trademarks and more generally all the other trademarks, illustrations, images and logos present on the SciaSciaCollection products, on the related accessories and packaging, whether registered or not, are and remain the exclusive property of the Seller. The total or partial reproduction, modification or use of the aforementioned trademarks, illustrations, images and logos, for any reason and on any medium, without the prior express agreement of the Seller is absolutely prohibited. The Site and its contents (including the shop section) may only be used for personal and non-commercial purposes.

11.2 Any combination of the aforementioned trademarks and other trademarks, symbols, logos and, more generally, any distinctive sign suitable for creating a composite logo is also prohibited.

11.3 The total or partial reproduction, modification, transfer by electronic or conventional means or the use of designs, models and patents, which are the exclusive property of the Seller and therefore protected by current legislation on signs, are also strictly prohibited. badges.

 

12 PRIVACY

12.1 All personal data is treated with the utmost confidentiality according to the directives contained in the "Privacy Policy", which can be viewed in the appropriate section of the Site.

 

13 APPLICABLE LAW

13.1 These General Conditions are governed by Italian law and will be interpreted on the basis of it, with the exclusion of the 1980 Vienna Convention on international sales.

13.2 For any dispute that may arise in connection with the General Conditions and/or the Sale and Purchase Agreements, the Court of Venice will have exclusive jurisdiction
